Scope of Service & Third-Party Limitations
Apex Sourcing Check provides independent, on-site visual verification, quality control, and report generation based on the state of items at the exact time of the physical visit. Apex Sourcing Check is a neutral inspection agency and is not a manufacturer, seller, or insurer of goods. We do not guarantee factory output post-visit.
Maximum Limitation of Liability
Under no circumstances shall Apex Sourcing Check, its parent company, or its on-the-ground contractors be liable for any consequential, incidental, indirect, or punitive damages, including but not limited to lost profits, factory production delays, border customs rejections, or defective bulk shipments. The total maximum financial liability of Apex Sourcing Check for any proven negligence or errors in reporting is strictly capped at a maximum amount equal to 100% of the single fee paid by the client for that specific inspection service.
Access Requirements & Force Majeure
The Client is solely responsible for ensuring that the target factory or supplier grants entry access to the dispatched Apex Sourcing Check inspector. If an inspector is denied entry due to factory hostility, lockouts, or lack of supplier authorization, a 100% service refund will be initiated, and Apex Sourcing Check stands relieved of all performance obligations.
Refund & Cancellation Window
Bookings can be canceled or rescheduled up to 24 hours prior to the scheduled factory floor deployment. Cancellations made inside the 24-hour window will incur a 50% logistical mobilization fee to cover local inspector travel booking costs.
Governing Law & Jurisdiction
These terms, transactions, and agreements shall be governed by, construed, and enforced exclusively in accordance with the laws of the Hong Kong Special Administrative Region (SAR), without regard to conflict of law principles. Any legal disputes must be settled through the courts of Hong Kong.
